Am I eligible?

Youth Law Australia is a community legal service that provides free and confidential legal advice, assistance and referrals to anyone 25 or  under. An accredited family dispute resolution practitioner (called canterbury family solicitors a ‘chairperson’) from our service will facilitate the dispute resolution conference. If a family dispute resolution practitioner assesses that it is appropriate to proceed to a family dispute resolution conference, lawyers will be consulted to confirm a conference date. Usually, the more availability you can offer, the more quickly the conference can be booked. Our case managers speak to each party individually and any independent children’s lawyer appointed.
If a family dispute resolution practitioner decides mediation is appropriate, then we will book a family dispute resolution session for you. A family dispute resolution practitioner (what we call a chairperson) will also run your dispute resolution session. Resources are tailored for schools, legal professionals, and culturally diverse communities in Melbourne’s west. Nigel has a community services background in youth support, housing advocacy, consumer affairs, and multicultural mental health, and now works as a family dispute resolution practitioner.

He was accredited as a family dispute resolution practitioner in 2024 and facilitates conferences for many First Nations families. He has a particular interest in seeing First Nations families achieve timely, fair and culturally appropriate outcomes and supporting resolution outside court where possible. If you qualify for legal aid, we may issue you a certificate to pay a family lawyer to give you legal advice and represent you. A non-litigation certificate, a type of voucher, may be issued if you want to try to resolve your child protection matter out of court.

‍Legal aid provides government-funded legal representation for individuals who cannot afford private lawyers, focusing on family law matters. You and the other person will meet to discuss your issues with an independent mediator. If you have a private lawyer they can attend, although this is not essential.
Each Community Law Centre runs differently – some give legal advice over the phone, some run drop-in legal clinics, and some ask you to make an appointment in advance. We are independent, confidential, and not part of the government. The mediation organiser will ask all parties or their lawyers to complete an intake and assessment checklist to help us decide whether the matter is right for mediation. It controls a number of programs and services for children and youth, including Children’s Aid Societies, Indigenous Child and Family Well-Being agencies, and adoption.
The case manager will have sought each client’s availability to attend and assessed the most appropriate venue and format for the conference, depending on participant needs. If your client needs an interpreter, we will arrange an interpreter for them at no charge at every stage of the FDRS process,  including the conference.
